Abstract

Three writ petitions were filed challenging the construction of the Worli-Bandra Sea Link Project. Since the existing infrastructure was over burdened by increase in traffic and there being no possibility of broadening the roads, a project was proposed starting at the intersection of the Western Express Highway and Swami Vivekanand Road at Bandra, connecting Khan Abdul Gafarkhan Road at Worli. A clover leaf interchange at the Mahim intersection and a flyover at the Love Grove intersection at Worli has also been proposed as part of the project. The petitioners opposed the project citing that under the CRZ Notification, 1991, reclamation of land between the High Tide Line and the Low Tide Line was prohibited as it would obstruct the flow of tidal waves; it was not in the larger public interest as it would lead to further congestion; that the original reclamation was confined to 4.5 hectares but it has gone upto 27 hectares; that the environmental clearance given by the Central Government was bad in law without proper environmental impact assessment; that the livelihood of the local fishermen would be affected due to displacement. The Bombay High Court quashed the petitions holding that the environmental clearance given by the Government of India for the project was not in breach of statutory provisions; reclamation of land was possible for sea-link projects; the sea-link project was in public interest with ever increasing traffic; that the project would not result in ecological damage, on the contrary would reduce burden of traffic on the existing infrastrucutre thereby reducing pollution; the project was included in the revised development plan in the Coastal Zone Management Plan which was approved by the Government of India.
