A writ petition praying that construction of an amusement park by respondent No. 4, within 200m of the High Tide Line near VUDA Park, Vishakapatanam, Andhra Pradesh, and the same being allowed by respondent No.1, was violative of the provisions of the Environment (Protection) Act, 1986, was quashed by the High Court of Andhra Pradesh on the ground that respondent No.1 had taken all measures for protecting and safeguarding the sensitive area in question before granting licence in favour of the 4th respondent and the same would not allow any activity that would be unsustainable or cause ecological destruction.
