Abstract

This paper examines the search by Regional Fisheries Management Organisations (RFMOs) for enlightenment in the context of the allocation of high seas fish stocks. Although allocation is essentially a political, or negotiated, process, in devising their allocation strategies RFMOs and their member states act within the context of a wide-ranging body of legal principles. It also makes suggestions for a reconceptualisation of the legal regime which might bring us closer to the elusive goal of enlightenment in the context of regional allocation issues.
